WHAT IS A MARKETING CONTRACT AGREEMENT?
A Marketing Service Agreement is an agreement between a marketing agency (the service provider) and their client that details the terms under which the service provider will provide their marketing services.
It lists out the terms and conditions relating to the marketing services provided and sets a clear framework for both the marketing agency and the client to know their rights and responsibilities.
Not to be confused with a proposal for services, the marketing contract is what comes after you have submitted your proposal with your capability statements and portfolio, and the client has shown an interest in working with you, or has agreed to move ahead based on indicative pricing. This is the stage where a marketing services contract is needed to move the lead from prospect to customer.
WHY DO I NEED A MARKETING CONTRACT AGREEMENT?
If you are engaging in service provision as a marketing agency or marketing freelancer, you will need a contract to protect your interests, and also give the client a clear understand of what is expected. Even the smallest of projects needs to have a clear understanding of what is in scope, what is NOT in scope (sometimes far more important) and what everyone has to do to ensure a smooth delivery process. By having everything clearly agreed to, it minimises potential disagreements, especially over scope of services.
WHAT IS INCLUDED IN THIS MARKETING CONTRACT AGREEMENT?
The Docushop Marketing Services Contract covers:
- Engagement Scope & Introduction to Marketing Services
- Products & Services
- Exclusivity & Competitors
- Compensation
- Billing & Payment

- Rights Upon Termination
- Default
- Notices

Utilise this contract for your next marketing venture & will help you do business with clients knowing you have all bases covered.
WHAT ARE THE BENEFITS OF HAVING A MARKETING CONTRACT AGREEMENT?
The benefits of having a contract agreement in place when engaging a new marketing client are:
- It helps set expectations with clients
- Gives you a written record of what is agreed with clients
- Sets your rights for payment default and ownership of IP
WHAT HAPPENS IF I DON'T HAVE A MARKETING CONTRACT AGREEMENT?
You open yourself up to the risk of things like scope creep, unclear deadlines and deliverables and confusion around what the client is meant to do to help the process. You also risk having unclear payment terms and standards, which means you may get paid late, or worse, not at all.
